To travel to the United States you need a visa. If you plan to go for tourism, you must process the tourism B1/B2 at the Embassy or at one of the 9 consulates they have in Mexican territory.

The tourist visa application process costs the equivalent of $160 dollars. Unfortunately, paying the fee is not a guarantee that your visa will be issued to you. Why?

All applicants must go through an interview with a consular officer. He questions about travel plans, but also reviews the personal, financial, and employment information provided on the DS-160 form.

After collating them and doing the interview, the US consular officer decides whether or not to grant the visa to the applicant. The most common reasons for rejection are given under section 214(b) and 221(g) of the Immigration and Nationality Act. They must always justify why they denied it to you.

 

Important note: During the coronavirus pandemic, you can go as far as scheduling your appointment for an interview, but for the moment, interviews for first-time procedures are suspended. The United States Embassy in Mexico will inform when they resume. Visa renewal appointments have already been resumed.

 

Section 214(b) Denial:

1) You did not prove to be eligible for the visa category. This can happen if you do not meet requirements such as a valid passport or even if you have previously violated immigration laws.

2) You did not show that you intend to travel only temporarily or that you have strong enough ties with your country of origin. The authorities fear that you will stay in the United States, when your stay permit has ended.

The consular authorities consider that a person has sufficient ties with their country of origin when they demonstrate that they have a job, house, family or reasons that make them return to their country (in this case, Mexico) after their trip to the United States.

Section 221(g) Rejection:

1) The application is incomplete and/or additional documentation is required. This happens when you failed to enter required information on the DS-160 form or when the information you entered caused doubts to the consular officer. In any case, they must tell you what additional documents you must present to be approved.

You have up to one year to submit the information, counting from the date your visa was denied. If you do not do it during that period, you will have to pay again for a new request.

2) Administrative processing. It means that you did not prove yourself eligible and require additional processing to be granted the visa. They will give you a letter with instructions and you can check your status on the page www.usvisa-info.com.

Depending on your case, it will be the waiting time. They generally take less than 60 days to resolve, but can take up to 6 months.

 

Is visa refusal forever?

It depends on the case, but most of the time, the applicant can reapply for a visa.

The recommendation is to process a new visa application until the situation for which you were denied has changed. For example, if you were turned down for not having a job, apply until you already have one.

Do you need many documents to obtain a tourist visa?

The consular officer will only ask for your DS-160 form confirmation and passport at the time of the interview.

If the question session gets complicated and asks you to prove that you will return to Mexico after your trip or that you have financial resources to support the expenses, you can present other supporting documents.

A proof of employment demonstrates rootedness because it indicates that you have a stable job in Mexico to return to. Submit a student letter or certificate (signed by your institution) if you are still studying.

Documents such as proof of payment receipts, account statements and proof of tax refunds are proof of economic solvency.
